TRAVISTA™ WORLDWIDE Policies and Procedures contained herein, explain and define the rights and responsibilities of the Independent Associate, a.k.a. Independent Business Owner or IBO with TRAVISTA™ WORLDWIDE , and governs the way he/she conducts their independent business.

The TRAVISTA™ WORLDWIDE Compensation Plan, the Independent Associate Application Form, the Policies and Procedures and operating terms and conditions for Independent Associates with TRAVISTA™ WORLDWIDE , constitutes the contract between Independent Associates and TRAVISTA™ WORLDWIDE . Any clarification, interpretation, exclusion or exception to this contract, in order to be effective, must be in writing and signed by an authorized officer of TRAVISTA™ WORLDWIDE.

TRAVISTA™ WORLDWIDE TERMS AND CONDITIONS:
1. I am of legal age in the state of my residency. I agree that I am an independent contractor of TRAVISTA™ WORLDWIDE and not an officer of the Company, nor an agent, employee, partner, or party in any joint venture with TRAVISTA™ WORLDWIDE , and at all times I must identify myself as such. I am responsible for determining my own business activities without control or direction by TRAVISTA™ WORLDWIDE.

I understand, as an Independent Associate with TRAVISTA™ WORLDWIDE , I will satisfy all federal, state/provincial, territorial, municipal and/or township and local laws and regulations.

2. I have carefully read these terms and conditions and the TRAVISTA™ WORLDWIDE Policies and Procedures, and agree to abide by all terms set forth in these documents.

3. In presenting the TRAVISTA™ WORLDWIDE home business opportunity to manner, and that any intentional misrepresentation of any information will result in action by TRAVISTA™ WORLDWIDE , up to and including, termination of this Agreement.

I understand that TRAVISTA™ WORLDWIDE 's Policies and Procedures are written to ensure compliance with the laws that govern advertising of the products and opportunities of TRAVISTA™ WORLDWIDE . Failure to comply with these Policies and Procedures can result in violations of local or national laws, which in turn may result in undesirable publicity, possible legal action and damage to TRAVISTA™ WORLDWIDE or its Independent Associates.

4. I acknowledge that I have not been a TRAVISTA™ WORLDWIDE Independent Associate, or a partner, shareholder, or principal of any entity having a TRAVISTA™ WORLDWIDE business within the past four months.

5. I understand, should I decide to purchase the TRAVISTA™ WORLDWIDE membership according to the 8 monthly installments, that there is no contract and I can cancel at any time. Should I decide to cancel my membership, I must submit my cancellation within 7 days prior to the next payment due, to prevent that next payment to be charged.

To cancel my membership, I must send an email to support@TraVistaWorldwide.com including my TRAVISTA™ WORLDWIDE username or ID number. I further understand that ALL SALES ARE FINAL and NO REFUNDS are allowed for any payments made up until that point of cancellation.

I understand that if the purchase of any TRAVISTA™ WORLDWIDE product creates any kind of financial burden on me that it is recommend I do not make any purchase at this time.

6. I understand that I have the right to terminate my TRAVISTA™ WORLDWIDE independent business at any time, with or without reason, by sending written notice to the Company address listed below. I further understand in the event of cancellation, termination or inactivity, I will permanently lose all rights as a TRAVISTA™ WORLDWIDE Independent Associate and I shall not be eligible to sell TRAVISTA™ WORLDWIDE products and services, nor shall I be eligible to receive commissions, bonuses, or other income resulting from the activities of my former downline sales organization.

7. I have the right to offer for sale TRAVISTA™ WORLDWIDE products and services in accordance with these Terms and Conditions.

8. I have the right to sponsor persons in TRAVISTA™ WORLDWIDE home business opportunity. I am also entitled to, in addition to upfront commissions, to participate in the TRAVISTA™ WORLDWIDE network marketing compensation plan.

9. I agree to fulfill my responsibilities as a sponsor, by assisting and supporting the Independent Associates in my sales organization and downline. I will respect the sponsorship relationships of other Independent Associates in the TRAVISTA™ WORLDWIDE organization and I agree not to cross sponsor these associates into any other network marketing or direct selling business. I will refrain from interfering with those relationships and will not make disparaging or untrue claims about any other Associate in the organization.

10. I understand that the TRAVISTA™ WORLDWIDE Independent Associate position does not constitute the sale of a franchise. No purchase has or will be required of me for participation as a TRAVISTA™ WORLDWIDE Independent Associate. I do understand however, that in order for me to qualify for commissions and bonuses I must maintain an active Business Center. A Business Center is active when a Travel Membership sale is made and attached to it and the customer is maintaining their purchase agreement. I also understand that this sale is made to a customer that does not participate in the TRAVISTA™ WORLDWIDE Compensation Plan. I further understand that I can make the purchase for myself and maintain the purchase agreement in lieu of the customer sale.

11. I agree that in order to maintain a viable Marketing Program and to comply with changes in federal, state and local laws and economic conditions, TRAVISTA™ WORLDWIDE may provide additional and modified Independent Associate Terms and Conditions, Policies and Procedures and Independent Associate Compensation Plan requirements and qualifications.

12. I understand that no Attorney General or other regulatory authority ever reviews, endorses or approves any product, compensation plan or company, and I will make no such claim to other as regards TRAVISTA™ WORLDWIDE .

13. I understand that the Independent Associate position can be inherited or bequeathed, but cannot be transferred or assigned during Independent Associates lifetime without the prior written consent of TRAVISTA™ WORLDWIDE , which consent will not be unreasonably withheld, but which will require the transferee to sign a current Independent Associate Agreement and to pay a minimal transfer fee.

14. I understand that this Agreement shall be deemed in effect upon its receipt and acceptance by TRAVISTA™ WORLDWIDE at its Home Offices in Winter Park Florida.

15. I agree not to promote my Independent Associate business nor use the TRAVISTA™ WORLDWIDE name, trade names, logos, sales materials, trademarks or service marks of TRAVISTA™ WORLDWIDE or of any affiliated TRAVISTA™ WORLDWIDE company, except in websites, sales and training materials provided, or as approved by TRAVISTA™ WORLDWIDE in writing for specific use.

16. I understand that this Agreement is governed by the laws of Florida. In the event of a claim of breach of this agreement or in the event a dispute shall arise as to the rights, duties and obligations of the parties under this agreement, it is agreed that such disputes shall be exclusively resolved pursuant to binding arbitration under the Commercial Rules of the American Arbitration Association with arbitration to occur at Orange County Florida.

The arbitrator may award, in addition to declaratory relief, contract damages and shall award reasonable attorney's fees and costs to the prevailing party. An award of attorney fees and costs shall continue through any review, appeal or enforcement of an arbitration award. An arbitration award may be enforced in any court of competent jurisdiction.

17. I indemnify TRAVISTA™ WORLDWIDE and its affiliates, officers, directors, employees, and other associates, its parent company and the affiliated subsidiaries of its parent company, "The Companies", as regards all claims, losses and damages incurred by The Companies as a result of a violation by Independent Associate of the provisions provided in these Terms and Conditions.

18. I understand that a husband and wife may have an interest in only one Independent Associate position. A son or daughter, of legal age, within the household is permitted to have their own Independent Associate position. Change of original sponsor is not permitted. The company will recognize only the first received sponsorship. If I wish to change my sponsor then I must resign my Independent Associate position and wait four months before I can reapply to be an Independent Associate under a different sponsor.

19. I understand that all Independent Associates, and membership subscriber lists and names, and all personal data thereto, are owned exclusively by TRAVISTA™ WORLDWIDE . And unauthorized use may result in damages to TraVista for which I may be liable.

20. I consent and authorize TRAVISTA™ WORLDWIDE to initiate ongoing e-mail communications to my email address, and I agree to inform my e-mail carrier of this authorization when requested to do so by TRAVISTA™ WORLDWIDE .

21. I understand that I may return literature and sales aids in resalable condition at any time within thirty days of purchase and receive 90% refund. Shipping costs for returned items shall be borne by the Independent Associate. Payment will be made within 30 days of actual receipt of returned items. The company will honor sales aids refund policies provided by any state or federal law applicable to Independent Associate

22. I understand that upon my Independent Associate application, I must submit my Social Security Number or the Employee Identification number for tax purposes. In the event earnings exceed $600.00 USD in a calendar year, TRAVISTA™ WORLDWIDE will submit a Form 1099 Miscellaneous Earnings Form to the IRS.

23. I understand that I must be up to date on the TRAVISTA™ WORLDWIDE compensation plan qualifications and guidelines for commissions and bonuses, and that any loss of commission and bonuses that I may lose or not qualify for because of my lack of understanding is solely my responsibility and no fault of TRAVISTA™ WORLDWIDE .

24. I hereby consent to TRAVISTA™ WORLDWIDE the use of my image (including but not limited to name, photograph, testimonials, likeness, position, voice, voices, biography, and any film footage, video tapes, audio tapes, recordings, and interviews) when created in connection with any TRAVISTA™ WORLDWIDE event, promotion or Company Convention to advertise, promote or publicize TRAVISTA™ WORLDWIDE products or opportunities. In the event this talent release is to be withheld by me, it is my responsibility to inform TRAVISTA™ WORLDWIDE 's Corporate Office in writing. I also understand that should I withhold this talent release, I may be restricted from attending some Corporate Events and/or Award Recognitions Functions.

25. I understand that I am allowed to give gifts to TRAVISTA™ WORLDWIDE employees. However, all gifts regardless of size or scope will be disclosed to TRAVISTA™ WORLDWIDE Compliance officer at the time of, or prior to the presentation or acceptance of the gift(s).

26. I understand that TRAVISTA™ WORLDWIDE employee's responsibility is to support and assist all Independent Associates. In order to avoid conflict of interest and to further the independent business of its Independent Associates, I will not attempt to sponsor TRAVISTA™ WORLDWIDE Corporate personnel or their immediate families, in order to maintain the confidentiality and neutrality of the employees. For the purpose of this paragraph "immediate family" refers to any person currently residing in the same household as an officer, employee, or appointed management staff.

27. I shall not request any confidential corporate information from TRAVISTA™ WORLDWIDE 's personnel which can jeopardize the employee's position with the Company, due to the confidentiality oath taken by all TRAVISTA™ WORLDWIDE personnel.

28. I understand that there may be chargebacks in commissions and bonuses.

29. I understand that I must not address any media or government inquires and that any inquires are to be addressed only by TRAVISTA™ WORLDWIDE , and must be referred immediately to TRAVISTA™ WORLDWIDE . This policy is to assure accurate and consistent answers, and that the public image is maintained.

30. I agree not to use TRAVISTA™ WORLDWIDE meetings, conference calls, group e- mails, group mailing lists or the products of TRAVISTA™ WORLDWIDE to promote, advertise, advocate, or otherwise express political, religious, or philosophical views. Any such promotion may give rise to disciplinary action, including termination.

31. I understand that I have the option to have TRAVISTA™ WORLDWIDE debit or place a hold on my first commissions for the month to pay for my monthly installment. I understand that TRAVISTA™ WORLDWIDE billing system looks 25 days in advance of any check that is earned by an associate, and if a payment is due, then the system will capture the monthly charge due, and will preclude a charge against my credit/debit card on file with TRAVISTA™ WORLDWIDE . This feature will also ensure no loss of commissions due to an expired credit/debit card on file.

32. I understand that I am responsible for providing TRAVISTA™ WORLDWIDE with updated credit/debit card information such as new expiry dates and new credit/ debit card numbers with authorization to TRAVISTA™ WORLDWIDE . Any change in credit/debit card information must be done a minimum of 5 business days prior to the next monthly recurring charge.

33 I understand that I am responsible for providing TRAVISTA™ WORLDWIDE with information regarding any changes of address or other pertinent information.

34. I understand that there are NO GUARANTEED EARNINGS, and I should not expect to earn an income without making membership sales or without referring new associates. Neither TRAVISTA™ WORLDWIDE , nor it's associates can guarantee earnings simply by becoming an Independent Associate. TRAVISTA™ WORLDWIDE associates should not purchase the membership subscription if they have no plans on using the membership.

By proceeding with my registration, I demonstrate my agreement to adhere to these terms and conditions.
